亞馬遜店鋪被停用賬戶,理由是欺詐性提交DMCA通知。目前店鋪A和B都已下架,目前還沒收到停用賬號通知,我需要怎么做,才能逃過一劫? 店鋪C被停用賬戶,這個問題要怎么處理?賬戶如何尋回?

然后我在12月底的時候店鋪A嘗試反通知申訴,在1月10日的時候通過并恢復(fù)ASIN了.?

接著我就讓店鋪B和C在1月10日當(dāng)日以同樣的方式提交了反通知,然后ASIN于1月28日也都恢復(fù)ASIN了?

1月31日的時候發(fā)現(xiàn)店鋪C被停用賬戶了, 理由為欺詐性提交DMCA通知.?

其中店鋪B是體量比較大的店鋪,我現(xiàn)在擔(dān)心因為這個反通知,三家店鋪都會受到停用賬戶的處理,尤其 店鋪B非常重要,店鋪C被停用賬戶之后,店鋪A和B已經(jīng)立即下架了鏈接.

1.店鋪C被停用賬戶,這個問題要怎么處理?賬戶如何尋回??
2.目前店鋪A和B都已下架,目前還沒收到停用賬號通知,我需要怎么做,才能逃過一劫??

?欺詐性dmca,很難申訴,我查過死因,比較無解

注意看最后幾個字,do not reins without legal approval,內(nèi)部查死因的備注是,沒有法律批準不得回復(fù),申訴的話,必須走法律程序(真實不侵權(quán),去起訴亞馬遜)

或者權(quán)利人發(fā)給亞馬遜撤訴,然后把撤訴信抄送給你,再去申訴,不然申訴就是會被拒絕

被判dmca欺詐有以下3種情況:
1、鏈接確實涉嫌侵權(quán),但還是提交了誤導(dǎo)性信息的DMCA(反通知);
2、在提交DMCA(反通知)前,對鏈接進行了修改;
3、鏈接不清楚是否侵權(quán),投訴人提供了法律等相關(guān)文件證明侵權(quán);

dmca已經(jīng)提交,這個已成事實,要想根本排除風(fēng)險,需要專業(yè)律師去和對方溝通,做一個和解,并且雙方簽訂和解協(xié)議書,這樣協(xié)議有法律效應(yīng),首先對方不會繼續(xù)提供法律文件,導(dǎo)致A,B店鋪有風(fēng)險,其次假如亞馬遜掃到你A,B賬號欺詐性dmca,你有和解協(xié)議書,這個是有法律效應(yīng)的,到時候假如被掃了,可以申訴A和B

被美國公司投訴版權(quán)侵權(quán),提交dmca之前一定要考慮清楚,畢竟對方在美國,起訴或者提供法律文件比投訴人是國內(nèi)的方便的多
