賬戶狀況顯示專利侵權(quán),某一個(gè)變體被下架,其他變體正常在售。變體之間只是顏色不一樣。
沒(méi)有收到任何的業(yè)績(jī)通知和郵件,只有賬戶狀況頁(yè)面顯示專利侵權(quán)。所以并不知道侵權(quán)的專利號(hào)和投訴人的任何信息。中英文case開了n個(gè),也跟賬戶團(tuán)隊(duì)打了電話,均回復(fù)查詢不到專利號(hào)或者其他信息。只是說(shuō)直接進(jìn)行申訴,證明實(shí)際并沒(méi)有侵犯他人專利。

目前產(chǎn)品詳情頁(yè)被刪,且無(wú)法再編輯,顯示此商品有其他發(fā)布限制。
我們自己也查詢了一下這個(gè)產(chǎn)品的相關(guān)專利,有發(fā)現(xiàn)一個(gè)跟我們產(chǎn)品類似的外觀專利。雖然并不完全一致,但我們的上架時(shí)間晚于該專利時(shí)間。

已經(jīng)進(jìn)行了兩次申訴,都失敗了。申訴思路是說(shuō)該專利跟我們產(chǎn)品實(shí)際并不一致。然后也有賣家在該專利生效之前就已經(jīng)開始售賣。

目前市面上有很多同款產(chǎn)品在正常售賣,我們下架的那個(gè)子體有200多個(gè)庫(kù)存,想知道還有什么別的辦法恢復(fù)鏈接。
或者說(shuō)目前只下架了一個(gè)子體,其他子體乃至店鋪后續(xù)會(huì)不會(huì)有什么風(fēng)險(xiǎn)。

繼第一個(gè)子體被下架后,最近其他變體也被下架。這次收到了亞馬遜的郵件,最終考慮時(shí)間等諸多因素,所以花錢跟專利權(quán)利人達(dá)成了和解,獲得了該專利的授權(quán)。
專利產(chǎn)品跟我們的產(chǎn)品一模一樣,我們也并沒(méi)有這個(gè)產(chǎn)品的國(guó)內(nèi)專利。專利無(wú)效化是一項(xiàng)巨大工程,最終我們選擇了放棄。

今年四月份,德國(guó)和英國(guó)分別遭到了競(jìng)爭(zhēng)對(duì)手的專利投訴(design right infringement).
背景:1:德國(guó)和法國(guó)遭到投訴。法國(guó)因?yàn)閍sin同步了德國(guó),所以直接連坐
2:對(duì)方專利注冊(cè)號(hào)比我們自己的專利號(hào)和鏈接的上架時(shí)間都早了一年

? ? ? 4:產(chǎn)品外觀相似度有八九成

收到投訴后立馬采取的措施
1:嘗試與對(duì)方和解,但是由于對(duì)方開出的條件太過(guò)苛刻,所以和解不了
2:注冊(cè)自己的專利號(hào)。(ps:歐洲專利真的是太狗了,不時(shí)審,只要申請(qǐng),基本都能注冊(cè)下來(lái),時(shí)間為三四周左右)
3:自己的專利號(hào)注冊(cè)下來(lái)以后,就可以去申訴了。后臺(tái)績(jī)效通知里面有申訴按鈕,我們是一個(gè)月自家專利號(hào)下來(lái)的時(shí)候才開始申訴。總共有三個(gè)asin,第一個(gè)asin申訴了六次才成功;第二個(gè)asin申訴了三次成功;第三個(gè)asin申訴了一次就成功。其中POA改了一次,也就是第一個(gè)asin第一次申訴不成功時(shí),改了一次poa,后面的所有申訴,poa都是一樣的,沒(méi)有再修改過(guò),因?yàn)閜oa內(nèi)容以后很詳細(xì),實(shí)在想不出修改的點(diǎn)了。
以下是不通過(guò)時(shí)亞馬遜回復(fù)的郵件,猜測(cè)是機(jī)器回復(fù),每次不通過(guò)時(shí)回復(fù)內(nèi)容都是一樣的!所以多申訴幾遍,也不用擔(dān)心什么浪費(fèi)申訴機(jī)會(huì)。

3:以下是POA申訴時(shí)的主要思路。走的是不承認(rèn)的申訴路線;
A:找出大概五點(diǎn)的不同點(diǎn),以圖片的形式具體展示出來(lái)。這時(shí)候需要仔細(xì)研究投訴方的專利圖片和鏈接,找出與自家的不同。我把投訴方的主圖與自家的主圖放在一起,這些不同點(diǎn)用小圖標(biāo)的方式圈出來(lái)放在一起做的對(duì)比。
B: 提供自家的專利號(hào)。這里需要點(diǎn)明專利已經(jīng)是注冊(cè)成功的狀態(tài),而不是pending中;同時(shí)附上專利鏈接
C:提供產(chǎn)品的歷史出單記錄。因?yàn)槲覀兊脑鲋刀惏l(fā)票已經(jīng)超過(guò)180天,所以提供發(fā)票已經(jīng)沒(méi)有意義了。所以改用歷史出單記錄,如果鏈接有好評(píng),最好也一起附上來(lái)證明產(chǎn)品的真實(shí)性。
最好需要附上詳細(xì)的今后行動(dòng)內(nèi)容,我們第一次poa這一點(diǎn)沒(méi)有寫詳細(xì),后面才補(bǔ)上,這一part內(nèi)容亞馬遜還是很看著的。

From the pics in these two patents, it is easy to know the differences between our 產(chǎn)品關(guān)鍵詞with theirs. Although they look similar at the fist sight, there are 5 differences in the designs. How did we deal with the complaint
1. Carefully investigated whether our products are infringing, and it is clear that we have no infringement.
2: We have contacted the patent complainant according to the email address to inform them of the company wrongful complain against our product and the losses it caused to us, and request them to withdraw their complain as soon as possible but did not get any reply.?

3. Carefully checked the description of all our product to make sure that they complies with Amazon's policy guidelines, especially regarding intellectual property and design copyright.
What we will do in future to prevent design right complaint
1: Before Designing, we will carefully make a search,not only on amazon, but also other platform to check whether the product has any other patent, copyright or trademark problem. Here is the link that we could check: https://www3.wipo.int/designdb/en/ and https://www.registered-design. ... ind/. If there is intellectual property, we will get the approval from right owner or we will make our product difference from the appearance, design, function and usage to avoid intellectual property problem.?

2: During sourcing, we will choose experienced and qualified supplier who have a better know of the market about the product from the view of intellectual property, quality, package and price of the product to avoid any product problem.

3: For description, we will make it clear the difference of our products on title, five points, pics and A+ description. And we will mention our patent No on five points too

4:For intellectual property, we will apply it to our products to protect ourselves and make it known on description for customers and other sellers.

5: For employee training, we organize regular training and learning seminars about platform policies, especially intellectual property policy.
