You are receiving this letter because you sell products that Amazon has identified as pesticides, including products making pesticidal claims. As you are likely aware, Amazon policy allows only U.S. residents to sell pesticide products and pesticide devices. Sellers must qualify to sell pesticides through our pesticides e-learning training module. A valid EPA registration number must be provided for each pesticide product, including products making pesticidal claims (with some limited exemptions).?

*Why would my product be identified as a pesticide?*?

Pesticides and pesticide devices include: (1) any product intended for preventing, destroying, repelling, or mitigating any pest and (2) any product that makes any antimicrobial, antifungal, antibacterial, anti-mold, or other pesticide claim. Common pests include insects, rodents, mites, bacteria, viruses and mold.
Examples of pesticides include insecticides, rodenticides, insect repellants, herbicides, etc. Examples of pesticide devices include ultraviolet light units, sound generators and insect traps. Under the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA), most pesticides must be registered with the Environmental Protection Agency (EPA). Pesticide devices must be labeled with an EPA establishment number.

*What is a pesticide claim and why is it important?*?

Amazon must provide buyers with information about products that is accurate and trustworthy. Claims about the properties of products must comply with applicable laws and regulations, and should not mislead customers about the qualities of the products.?
Pesticide claims about killing or preventing pests, such as “kills viruses,” “prevents mold,” or “anti-microbial” are regulated by the EPA. They are permitted on Amazon provided the product has valid EPA registration or qualifies for an exemption from registration. Claims on pesticide devices must comply with EPA requirements and be labeled with an EPA establishment number.
Other claims are inherently false or misleading and are never allowed. This includes claims that a product is “EPA approved” or “chemical-free” and public health claims. *What makes a pesticide compliant?*

The EPA requires registration of most pesticide products for sale in the United States, including products making pesticidal claims. Products must have a valid EPA registration number and establishment number, which must be clearly labeled on the product. There are limited exemptions to registration.
