產(chǎn)品首批剛上架兩小時就被盯上投訴下架，專利人申請了產(chǎn)品其中一些配件的發(fā)明專利（別人申請專利的產(chǎn)品是我們產(chǎn)品的一部分），現(xiàn)在基本坐實侵犯了別人的發(fā)明專利。?

請問下大家：
1--- 我們的產(chǎn)品是在對方的基礎了加了主體，成為了新產(chǎn)品。雖然外觀不是很像，但是是把手是用的他們的，這種發(fā)明專利侵權申訴有沒有希望

2---穩(wěn)妥的方式是想和對方和解，求一份撤訴信的模板（事先確實不知道侵權，對方申請的是那個配件的專利，專利檢索時用的關鍵詞是整個產(chǎn)品的關鍵詞）

如果你售賣的產(chǎn)品包含了那個有發(fā)明專利的配件，因為產(chǎn)品用到了那個發(fā)明專利把手的功能，這個角度確實就是侵權了

先找知識產(chǎn)權律所或者機構，讓在美律師看還有沒有其他角度能出發(fā)，做不侵權產(chǎn)品分析，看有沒有一絲機會
