最近有不少亞馬遜賣家接到了侵權(quán)的指控，導(dǎo)致亞馬遜賬號關(guān)閉或者鏈接被移除。每年臨近旺季，亞馬遜肯定會有一波大動作的，搬磚不易，望各位賣家謹(jǐn)慎經(jīng)營，提前規(guī)避。
火火有客戶小美，一直是精品模式，店鋪經(jīng)營很合規(guī)，找火火一般都是產(chǎn)品被投訴二手，濫用變體這種小問題。最近他們開私模的一款產(chǎn)品被投訴專利侵權(quán)。郵件如下：
Hello,
We received a report from a patent owner who believes the items listed at the end of this email infringe their U.S. Patent No. XXXXXXXXX.
If you wish to continue selling the items listed at the end of the email, you have two choices.
First, you can choose to resolve your claim with the patent owner directly within the next three weeks.??If we receive a retraction from the patent owner within the next three weeks, we will allow you to continue selling the items listed at the end of this email.??The patent owner's contact information is as follows:

? ?? ???接到這個投訴的時候，該產(chǎn)品正處于上升時期，每天都有很可觀的銷售額。我迅速查詢了一下該專利的情況，包括申請時間，專利的內(nèi)容，有2點發(fā)現(xiàn)：1，該專利的申請時間比該產(chǎn)品在亞馬遜上的銷售時間要晚13個月。2，該專利的內(nèi)容和小美的產(chǎn)品確實有很大的差異，這種差異不僅是在外觀上，而是在功能上，應(yīng)用領(lǐng)域上，都有很大的不同。作為亞馬遜資深賣家，小美在開私模前就已咨詢過專業(yè)的律師，排除過知識產(chǎn)權(quán)侵權(quán)的風(fēng)險。
小美已經(jīng)投入了不少資金在這個產(chǎn)品上，有強(qiáng)烈的意愿要把產(chǎn)品申訴回來。
首先，我們聯(lián)系了該投訴人，郵件告知他我們并不知曉該產(chǎn)品哪里侵權(quán)了，并表達(dá)了和解的愿望。但是過去了兩三個星期，還是沒有得到對方的任何答復(fù)。
在聯(lián)系投訴人的同時，我們已經(jīng)計劃走亞馬遜專利中立評估程序了。
什么是亞馬遜專利中立評估呢？這里做一下詳細(xì)介紹：
亞馬遜專利中立評估（Amazon Utility Patent Neutral Evaluation Procedure）是亞馬遜于2019年推出的一個新服務(wù)。它僅限于實用新型專利，雙方（投訴方和被投訴方）自愿且成本相對較低（與聯(lián)邦專利訴訟或在美國停止進(jìn)口侵權(quán)產(chǎn)品的程序相比）。
當(dāng)賣家收到被投訴的通知時，被投訴的賣家可以選擇與權(quán)力所有人和解，請權(quán)力所有人撤銷投訴。
但被投訴賣家也可以選擇專利中立評估的方式來爭取自己的權(quán)益。被投訴的賣家會收到亞馬遜的《中立專利評估協(xié)議》。被投訴賣家有3周的時間來考慮，并通知亞馬遜是否同意參加中立專利評估程序。如果同意，listing還可以正常售賣，直到中立評估結(jié)束。（實際操作中，不一定是這樣，小美的listing在收到通知的當(dāng)日就已經(jīng)被下架。）
如果不同意，或者不答復(fù)，亞馬遜將移除被指控的鏈接。如果雙方都同意參加中立評估，亞馬遜會選擇一名中立的第三方專利律師，并要求各方向評估人員支付4,000美元的押金。評估結(jié)束后，亞馬遜會退還4000美元的押金給勝訴的一方。
對于小美遭受的這類投訴，侵權(quán)證據(jù)不充分，選擇亞馬遜專利中立評估是很好的選擇。
我們填寫了所有的協(xié)議和表格，并在律師的協(xié)助下準(zhǔn)備了包括產(chǎn)品上架時間證據(jù)，產(chǎn)品采購合同，銷售訂單詳情，產(chǎn)品設(shè)計文稿，公司網(wǎng)站等資料。
當(dāng)雙方都同意參加評估程序后，將依照時間表提供各自的相關(guān)觀點和證據(jù)：

在收到所有的書面資料后，中立評估機(jī)構(gòu)將在14天內(nèi)對侵權(quán)與否作出判決。
從時間表來看，中立評估程序的確是一項復(fù)雜耗時間的工作。但對亞馬遜上泛濫的惡意投訴來說，我們有理由相信，亞馬遜的專利中立評估程序會給合規(guī)經(jīng)營的賣家?guī)砀嗟南Ｍ?br /> ?
