近日來(lái),陸續(xù)有不少賣(mài)家收到一封亞馬遜的郵件,郵件內(nèi)容大致就是店鋪里的Generic產(chǎn)品涉及侵權(quán)要求提供發(fā)票,授權(quán)等證明需要接受審查,并且會(huì)在郵件末尾附帶告知是哪些Generic產(chǎn)品.(其實(shí)過(guò)年期間DE就開(kāi)始有人收到,現(xiàn)在陸續(xù)CA,US都有收到類似郵件的)

那么問(wèn)題來(lái)了,亞馬遜Generic的含義就是通用,無(wú)品牌,為什么會(huì)收到侵權(quán)的郵件?
首先我們需要了解一下亞馬遜官方對(duì)“Generic”的解釋:

簡(jiǎn)化版的中文大意:不要在Brand和Manufacturer信息里填寫(xiě)賣(mài)家店鋪名.如果是非品牌產(chǎn)品就要在Brand欄里填寫(xiě)Generic即可。
據(jù)小道消息稱:Generic已經(jīng)被惡意注冊(cè)為商標(biāo),再然后投訴這些原本就是Generic的賣(mài)家侵權(quán),于是導(dǎo)致了這次Generic侵權(quán)行動(dòng)....
Generic 難道真被注冊(cè)了商標(biāo)?于是我顫抖了查了一下...
然而并沒(méi)有像謠傳說(shuō)的那樣,Generic并沒(méi)有被成功注冊(cè)(雖然有不少嘗試者)至少目前還是DEAD狀態(tài)。
更何況即便你注冊(cè)成功,拿著Generic商標(biāo)來(lái)亞馬遜備案,恐怕亞馬遜也是不可能給你備案成功的。倘若備案成功了,你這啪啪啪的打亞馬遜的臉,多不好。
那么這次“小規(guī)模的行動(dòng)”到底是什么原因造成的呢?

產(chǎn)品可能涉嫌侵犯知識(shí)產(chǎn)權(quán) 或者 可能涉嫌假貨
或者 或者 或者....真讓人心碎,為什么就死盯著認(rèn)為是侵權(quán)造成的呢?加上亞馬遜要求提供的文件里大多是商標(biāo)證明,授權(quán),進(jìn)貨發(fā)票...這一切就比較好理解了。
亞馬遜僅僅是想核實(shí)這些Generic產(chǎn)品是不是正規(guī)產(chǎn)品,是不是侵權(quán)。
于是我們又有了一個(gè)感覺(jué),本次群殺是有范圍的。
于是我們收集到了眾多“受災(zāi)群眾”,核實(shí)了一下,受災(zāi)賬號(hào)平均年齡為3-6個(gè)月(少數(shù)超過(guò)6個(gè)月,但是不超過(guò)一年)。也就是所謂的“新賬號(hào)”...
于是基本猜測(cè)如下:亞馬遜針對(duì)一些新賬號(hào)中使用Generic出售的產(chǎn)品.來(lái)了一輪“群殺”??梢岳斫鉃閬嗰R遜遵循“疑罪從有”的原則放了一波大招...
(先假定你有罪,然后要你來(lái)證明你無(wú)罪,證明得了就放,證明不了就關(guān))
下面的觀點(diǎn)僅供參考,忠言逆耳,不喜勿噴。
**一。無(wú)Generic產(chǎn)品的賣(mài)家如何預(yù)防?**
注冊(cè)自己的公司,正規(guī)化操作。
注冊(cè)自己的品牌商標(biāo),產(chǎn)品盡量使用自己的包裝。
進(jìn)貨增值稅發(fā)票要常備...
UPC要正規(guī),保留條碼證明。
品牌產(chǎn)品官網(wǎng)獨(dú)立站的搭建。
以上五點(diǎn)將會(huì)是應(yīng)對(duì)亞馬遜各種審查,各種惡意跟賣(mài),各種產(chǎn)品被惡意修改等等申訴的有效幫助手段。而345是當(dāng)前絕大多數(shù)人還意識(shí)不到重要性的地方...
**二。有Generic產(chǎn)品目前還沒(méi)中招的如何預(yù)防?**
有品牌的產(chǎn)品不用Generic,無(wú)品牌的的產(chǎn)品不用虛擬品牌或者店鋪名。(不要掛羊頭賣(mài)狗肉)
沒(méi)有自己商標(biāo)的盡快注冊(cè),參考上面123456,甚至還需要避免被搶注的情況。
**三。已經(jīng)中招的如何申訴?**
表明清楚自己產(chǎn)品沒(méi)有問(wèn)題,是正規(guī)渠道進(jìn)貨的誠(chéng)信賣(mài)家。
盡量多的提供進(jìn)貨增值稅發(fā)票,合同,授權(quán),商標(biāo)等一切證明自己“無(wú)罪”的證據(jù)。
闡明Generic產(chǎn)品是亞馬遜官方規(guī)定的無(wú)品牌產(chǎn)品Brand用法。具體原文可以后臺(tái)搜索Generic查詢。說(shuō)明自己就是根據(jù)亞馬遜規(guī)定來(lái)做的,并無(wú)違規(guī)和侵權(quán)行為。
