某大賣:2,000封未讀郵件,驚見亞馬遜中立評估程序,怕了怕了!
我們的一位大賣朋友,看到自己郵箱里面的一封郵件,急得跳腳,火急火燎來找我們。
郵件亞馬遜美國律師函,內容如下:
We received a report from a patent owner who believes the items listed at the end of this email infringe their patent: xxxxxxxxxxxxx.

If you wish to continue selling the items listed at the end of the email, you have two choices.
?
First, you can choose to resolve your claim with the patent owner directly within the next three weeks. If we receive a retraction from the patent owner within the next three weeks, we will allow you to continue selling the items listed at the end of this email.

If the patent owner agrees to retract their complaint, they must send the retraction directly to us at patent-evaluation@amazon.com. Forwarded retractions will not be accepted.

Second, you can choose to participate in neutral evaluation of the patent owner’s claim. Amazon’s neutral evaluation procedure is described in the attached document titled “Amazon Utility Patent Neutral Evaluation Procedure.” Please read this document carefully and note that payment of a fee is required. If you choose to participate in the neutral evaluation, you must agree to the attached Amazon Utility Patent Neutral Evaluation Agreement, complete Exhibit 2 of the Agreement, “Seller-Supplied Information,” and return the completed Agreement to patent-evaluation@amazon.com within three weeks.

Please note that participation in the evaluation process does not guarantee that you will be able to continue to sell the items listed at the end of this email following the evaluation. If the evaluator decides that the items likely infringe, we intend to remove them from Amazon.com. If, however, the evaluator decides the items likely do not infringe, we will not remove your listings from Amazon.com.

If you do not either resolve your claim with the patent owner directly, or agree to participate in the neutral evaluation process, we will remove the listings at the end of this email from Amazon.com.

再次來分析下這個中立評估程序:
1:可以簡單理解為,亞馬遜又一個為解決侵權推出的計劃,目前只針對實用新型專利,但是后續(xù)可能會針對更多的知識產權領域,例如外觀專利,發(fā)明專利,商標,版權等。

2:這個計劃有點“狠”。我們都知道亞馬遜原本就有投訴侵權的平臺機制,但是這種投訴是免費的,所以就導致很多惡意投訴,或者錯誤投訴。但是該專利評估程序是收費的,并且費用還不低:4,000美金,你說你要不是有十足的把握你會動用該機制去投訴別人嗎。同樣道理,被投訴的人,如果不是有充分的信心也不敢回擊,只能乖乖刪除產品。

3:相對起平臺投訴,這個專利評估制度顯然更加嚴謹,規(guī)范,有力,對比直接找美國律所起訴侵權,該制度的操作顯然更加方便快捷。

4:雖然該專利評估程序目前只有少數的例子,并且執(zhí)行方面存在一定的異議,但目前來看,該制度還是有很大的發(fā)展空間,不排除以后會廣泛應用。

細數一下,各大電商平臺為了防止品牌侵權真的是用盡心思,不僅有各種平臺投訴,還推出了各種各樣的加強版計劃,最可怕的是,各大美國律所,也是一直緊盯著中國市場,中國賣家被告數不勝數。品牌是發(fā)展的基石,短期來看是電商平臺政策要求,長期來看更是拉開競爭對手,立足海外市場的必要投資,任何銷售都應該建立“不侵權”的前提之下。由此可見,國際商標專利注冊,版權登記保護刻不容緩!
